The only thing that make this a dirty hit is the fact that the puck was gone long enough for the hit to be unnecessary. Had Zubrus not lowered his has at the last second he also wouldn't have been hurt. It's still a dirty hit don't get me wrong, but was it really suspension worthy? I personally think not.
