These types of cases often get settled out of court. The Kraken will likely pay him out an amount and maybe buy the rights outright.

This is so frivolous, dude should be happy it's and homage to his design. He's just being a weenie. I think they're too different for the Kraken to be proven guilty of infringement, but who knows.
I think they will settle, but it’s not infringement. The esses while being red are completely different. It is Seattle Kraken‘s actual logo with Kraken in the center and then the stripes spin is entirely different and coloration, spacing etc. to me, and my eyes the owner of the Seattle metropolitan logo is reaching for this lawsuit.
i know some people may disagree with this but I get my NHL jerseys from dhgate (I live in the UK) because I cant justify over £100 for one jersey. if they do go out of stock id like to think that they might still do them on dhgate somewhere at some point. I'm a ducks fan and I would just love to have one of these but again I cant be spending over 100 on a jersey that isn't even my team. plus I'm a student on a budget so that's also an factor lmao

Isn’t the logo they used a trademarked logo owned by Seattle? Other than the red and lettering, that’s the logo they usually use.
By Kim’s logic, the fact the jersey has striping that’s sorta kinda not really similar should be an issue aswell.
I think you are out of your mind if you think Kim will win this. His logo is not even a logo. It is a Normal letter with the name of the city inside of it. The Kraken used their existing logo and put the team nickname inside of it, not even the name of the city. The horizontal striping is also not similar other than it is horizontal which all teams used from that era (look at the Ottawa retro jerseys). I can't see this going anywhere and there is zero chance that Seattle wouldn't have run this by their legal team prior if they already had a contentious relationship with Kim. Kim is hoping he can be enough of a nuisance that they will just settle with him to make it go away because he is screwed if this goes to court.
I think this case gets settled, not because the Kraken are losing and give in to Kim's request, but the opposite. I think the Kraken ran this by multiple lawyers already and they know they have an easily defendable jersey from the copyright. I think Kim sees how easy it is to get around it and sells off the copyright to some sort of compromise, but probably closer to the Krakens number.
How many things in this world are inspired by something else? This guy has just been waiting for an opportunity like this so he could try to make big money. It's the American way, I suppose. Watch out if you're a clothing manufacturer. Make sure there's no 'S' on any striped shirts you sell.
But I predict this will be settled out of court, with the Kraken giving this guy too much money just to go away.
I think they originally offererd 2 pairs of season tickets and 5% of all jersey sales to use the actual jersey and logo. He declined so they worked with own attorneys to design the jersey and logo they used. I don think people would be confused between the two designs.
Definitely inspired but I see nothing wrong, easy to prove. While different style/shape using their own logo. Different Hue of red, different wording and doesn’t go down the whole logo. His is an S and krakens is a tentacle is what I’d say. His doesn’t have an eye so his is a letter and krakens is an object shaped as an S

The Seattle Kraken is the dumbest, least offensive, and therefore lamest and weakest name they coulda chosen.
They already had INSTANT Stanley Cup cache with the “Metropolitans”… but of course dirty Buttman has one of his precious idiot Divisions named that.. so that wouldn’t do.

If anything, it's Kim who should be worried. As he seemingly owns the rights to the Metropolitans' identity and uniforms, those uniforms are suspiciously similar to that of the Leicester Tigers, and I do believe they had first dibs on those colours.
The 1917 on the collar is dead give away for the Metropolitans..

Kim hasn't used the trademark. It's effective expired. The metropolitans haven't existed in a century.
They changed it more then 10% they should be fine. You are allowed to take inspiration from things.

It is an absolute travesty that this guy was ever given a trademark for something that he absolutely has no right to have a trademark for. The Metropolitans' legacy should belong to the city of Seattle. He doesn't deserve a penny & anything they offered him was more than he deserves.
